European Union-U.S. Data Privacy Framework announced

On October 7, President Biden signed an Executive Order to implement the EU-US Data Privacy Framework, which sets the legal basis on the US side for the successor agreement to the EU-US Privacy Shield. View the Fact Sheet here.

The immediate next steps are that the European Commission will issue a draft “data adequacy assessment” for the United States, which must be approved and adopted by the 27 EU member states. For reference, this agreement will also unlock the ability for the U.S. to negotiate similar frameworks with the UK, Switzerland, and other non-EU markets across Europe.
